Analysis note the pitfalls of an aggressive iPhone legal defense


CNBC posts a bit on Apple's apparent plans to come out swinging against perceived iPhone knock offs. Specifically, Palm's new Pre touch-screen smartphone. The shot across the bow came bluntly from Apple COO Time Cook during an earning call, describing the products ambiguously referenced as "ripping off" Apple's stuff.

The issue in question is Apple's rights to the multi-touch interface. Apple was granted a patent for its innovation; however, similar innovations are already on the books. It could create an interesting challenge, which not only would behoove Apple to take on other players such as HTC and RIM, but could put Apple's own claims under the microscope, not to mention considerable expense.

It's yet to be seen whether Apple follows through with its legal threats as a viable option for maintaining it's growing dominance in the smartphone market. Perhaps more likely, Apple is putting on a tough show to deter and slow other players.
