Apple unleashes DMCA on PsyStar


ZDNet reports that court papers filed by Apple the day before Thanksgiving (perhaps to add a note of vehemence?) indicate the Mac maker has added new charges against PsyStar and 10 "John Does." Specifically, the mothership cited violations of the Digital Millennium Copyright Act (DMCA) for bypassing copy-protections embedded in Mac OS X.

Through this motion, Apple seeks leave to file its Amended Complaint pursuant to Federal Rule of Civil Procedure 15(a) and this Court's November 7, 2008 Case Management Order. Apple's Amended Complaint, attached hereto as Exhibit A, adds a Digital Millennium Copyright Act claim, additional factual allegations relating to Apple's previously asserted claims and Doe defendants. The DMCA claim is based on new information that Apple has learned since the filing of its original complaint.

Microsoft Office 2008 for Mac Special Media Editio


This move has been expected since PsyStar announced themselves, ripped off an open-source developer, moved and moved again,shipped a computer that sounded like a jet engine taking off and bogusly assert an anti-trust defense (among other offenses).

ZDNet asserts that asserting DMCA violations provides Apple an expedited way (think injunction) to force PsyStar to stop selling Mac clones.

Whatever the reasoning, here's hoping PsyStar is little more than the memory of a sniffle by Christmas...
